This User Agreement (hereinafter referred to as the «Agreement») sets out the rules for using the WORKIUM website, as well as the rights and obligations of users and WORKIUM OÜ.
By using the WORKIUM website, creating an account, viewing vacancies, or using any functions of the service, you confirm that you have read this Agreement, understand its contents, and agree to comply with its terms.
If you do not agree with any provision of this Agreement, we recommend that you stop using the WORKIUM service.
WORKIUM is an online platform for finding work abroad that provides users with access to vacancies, information about employers, working and accommodation conditions, and other materials related to employment.
Additional rules, terms, or policies may apply to particular WORKIUM functions or services. Where such documents exist, they form an integral part of this Agreement.
Use of the service is also governed by the following documents:
Privacy Policy;
Personal Data Protection;
Cookies Policy;
Public Offer (where applicable);
Payment and Refund Policy (for paid services).
In the event of any conflict between this Agreement and the specific rules of a particular service, the specific rules shall prevail unless expressly stated otherwise.
For the purposes of this Agreement, the following terms have the meanings set out below:
WORKIUM — an online platform for finding work abroad, owned by WORKIUM OÜ and available at https://workium.net.
Company — WORKIUM OÜ, a legal entity that owns and administers the WORKIUM service.
User — any natural or legal person who visits the website, uses its functions, or creates an account.
Candidate — a user who uses the service to search for work, submit applications for vacancies, or interact with employers.
Employer — a legal or natural person who posts vacancies or offers work through the WORKIUM service.
Vacancy — information about a job offer published on the WORKIUM platform.
Service — the WORKIUM website, its software, functionality, tools, and related digital services.
Account — a user's personal profile created after registration that provides access to additional service features.
Personal account area — a protected part of the service available after the user logs in.
Content — any texts, photographs, logos, graphic materials, vacancies, descriptions, documents, reviews, and other information posted on the platform or uploaded by users.
Terms not defined in this Agreement shall be interpreted in accordance with applicable law and the generally accepted meaning of such terms in the field of information technology and electronic services.
This Agreement governs the use of the WORKIUM service and defines the rights, obligations, and liability of users and WORKIUM OÜ.
WORKIUM enables users to:
view vacancies posted on the platform;
search for vacancies using various criteria;
create and use a personal account area;
apply for vacancies;
view information about vacancies, working and accommodation conditions, pay levels, candidate requirements, and other information related to the relevant vacancy;
use other functions and services available on the platform.
WORKIUM is a platform for finding work abroad that brings together candidates, employers, operational partners, and other participants in the employment process. Depending on the particular vacancy, service, or cooperation model, the Company may provide informational, advisory, organisational, and other support related to job searching and the employment process.
The Company seeks to ensure that the information posted on the platform is current, complete, and accurate, and also carries out vacancy verification in accordance with its internal procedures. At the same time, the final employment conditions, the conclusion of an employment or other agreement, and the mutual rights and obligations of the parties are determined by the relevant participants in the employment process, depending on the specific vacancy and applicable cooperation model.
Certain service functions may be available only to registered users or may be provided subject to additional conditions communicated to the user before they begin using them.
The Company may expand, change, supplement, or discontinue particular service functions, provided that this does not conflict with applicable law or infringe users' rights.
Additional terms, rules, or agreements may apply to particular services provided through the WORKIUM platform. Where applicable, such documents form an integral part of the legal relationship between the parties and apply together with this Agreement.
To use certain functions of the WORKIUM service, a user may be required to create an account.
During registration, the user undertakes to provide accurate, current, and complete information and to update it promptly if changes occur.
The user is responsible for keeping their account login details confidential and for all actions carried out through the account.
If login details are lost, unauthorised access is suspected, or another security breach occurs, the user must notify the Company without undue delay and take all possible steps to protect the account.
The Company may use additional methods to verify identity, contact details, or other information where necessary to ensure service security, prevent fraud, comply with legal requirements, or provide services properly.
The user undertakes to use only their own account and not to provide third parties with access to it.
It is prohibited to:
create accounts using false, inaccurate, or another person's personal data;
use another person's account without their permission;
transfer, sell, give away, or otherwise dispose of an account;
use the service for unlawful activities, to infringe the rights of others, or to circumvent the platform's technical restrictions.
The Company may temporarily restrict access to an account, suspend it, or block it in the event of:
a breach of this Agreement;
signs of fraud, abuse, or unauthorised access;
the provision of inaccurate information;
use of the service in violation of legal requirements;
the need to protect the platform, other users, or comply with the requirements of competent public authorities.
Provided that doing so does not conflict with legal requirements, security interests, or an ongoing investigation, the Company may inform the user of the reasons for restricting access to or blocking the account.
The user may stop using the service at any time and request deletion of their account. Deletion of the account does not affect the rights and obligations of the parties that arose before its deletion and does not release the Company from the obligation to retain information where and for as long as required by law or other legal grounds.
The user has the right to:
use the WORKIUM service in accordance with this Agreement and applicable law;
view vacancies and other information posted on the platform;
use the functions of the personal account area where they are available for the relevant account;
apply for vacancies and use other services available on the platform;
contact WORKIUM support regarding the use of the service;
notify the Company about inaccuracies in vacancies, technical errors, possible cases of fraud, or other violations related to the operation of the platform;
exercise other rights provided for by this Agreement and applicable law.
The user undertakes to:
use the service in good faith and exclusively for lawful purposes;
provide accurate information during registration, when submitting applications, or when using other service functions;
comply with this Agreement and other documents governing the use of the platform;
not take actions that may interfere with the operation of the service, compromise its security, or create an excessive load on its infrastructure;
not use automated tools, software, scripts, bots, parsers, or other technologies for the mass collection of information, automated interaction with the service, or circumvention of established technical restrictions without the Company's prior written consent;
not post, transmit, or distribute information that is unlawful, false, offensive, discriminatory, harmful, or infringes the rights of third parties;
not take actions aimed at obtaining unauthorised access to the service, other users' accounts, servers, software, or any other components of the platform;
not use the service in a manner that may harm the reputation of WORKIUM, other users, partners, or employers.
The user is solely responsible for the accuracy of the information they provide, the lawfulness of their actions while using the service, and compliance with legal requirements.
The Company has the right to:
ensure the operation, development, administration, and technical support of the WORKIUM service;
improve, change, expand, restrict, or discontinue particular functions, services, or sections of the platform;
carry out vacancy verification and review information and other content posted on the platform in accordance with the Company's internal procedures;
refuse publication, temporarily hide, edit, or remove vacancies, accounts, or other content in the event of a breach of this Agreement, legal requirements, or the Company's internal rules;
temporarily restrict access to the service or particular functions where necessary for security, technical work, compliance with legal requirements, or the proper operation of the platform;
interact with employers, operational partners, and other persons involved in the employment process as part of the service;
use automated and non-automated means to ensure security, verify information, prevent fraud, improve service quality, and comply with legal requirements;
take other actions necessary for the proper operation, development, and protection of the service, provided that they do not conflict with the law or this Agreement.
The Company undertakes to:
ensure the operation of the service within the available technical capabilities;
take reasonable organisational, technical, and administrative measures to ensure service security and protect information;
review user requests within a reasonable period in accordance with the Company's internal procedures;
verify vacancies in accordance with WORKIUM's internal rules and procedures;
comply with legal requirements regarding the processing and protection of personal data;
perform in good faith other obligations provided for by this Agreement and applicable law.
The Company makes reasonable efforts to ensure the continuous and stable operation of the service but does not guarantee uninterrupted or error-free operation. The availability of particular functions may be temporarily restricted due to maintenance, software updates, troubleshooting, actions of third parties, force majeure, or other events beyond the Company's reasonable control.
WORKIUM provides users with access to vacancies and other information related to employment abroad.
The Company verifies vacancies in accordance with WORKIUM's internal rules and procedures, but does not guarantee that information provided by employers, operational partners, or other persons is completely accurate, complete, or will remain unchanged after publication.
Information posted on the platform may be updated, changed, or become outdated due to changes in employment conditions, employers' decisions, changes in legislation, or other circumstances beyond the Company's control.
The Company may at any time review, edit, update, temporarily hide, or remove vacancies or other information posted on the platform where necessary to ensure data accuracy, user safety, compliance with legal requirements, or compliance with the Company's internal rules.
The Company makes reasonable efforts to support the successful employment of candidates but cannot influence employers' decisions, interview results, candidates' compliance with vacancy requirements, changes in employment conditions, or other circumstances arising after publication of a vacancy or beyond the Company's reasonable control.
The user independently decides whether to apply for a vacancy, attend an interview, conclude an employment or other agreement, or take other actions related to employment.
If, after a vacancy is published, the user discovers information that may indicate inaccuracy, a change in employment conditions, or other violations, the user may report this to the Company by any available method. The Company reviews such reports in accordance with WORKIUM's internal rules and procedures and, where necessary, conducts an additional review.
The Company is not liable for the decisions, actions, or omissions of employers, operational partners, or other persons who independently make decisions within the employment process, unless otherwise provided by law or separate agreements.
All intellectual property rights in the WORKIUM platform, its software, design, structure, functionality, texts, graphic materials, logos, trade designations, photographs, databases, and other objects placed on the platform belong to the Company, its partners, or other rights holders and are protected by intellectual property law.
The user is granted a limited, non-exclusive, revocable, and non-transferable right to use the platform exclusively for personal purposes in accordance with this Agreement.
Without the prior written consent of the Company or another rights holder, it is prohibited to copy, reproduce, modify, translate, distribute, publish, sell, license, transfer to third parties, create derivative materials, decompile, reverse engineer, or otherwise use any materials or elements of the platform, in whole or in part, except where expressly permitted by law.
The user is also prohibited from using automated tools, software, robots, parsers, scripts, or other technologies for the mass collection of information, copying vacancies, creating databases, or otherwise using information posted on the platform without the Company's prior written consent.
The name «WORKIUM», the WORKIUM logo, corporate identity, design elements, and other designations used by the Company are intellectual property and may not be used without the Company's prior written consent, except where expressly provided by law or agreed by the Company in writing.
The posting of vacancies, photographs, descriptions, logos, or other materials on the platform does not transfer any intellectual property rights in such materials to users.
Any use of platform materials, including vacancies, photographs, descriptions, design elements, website structure, or databases, for the purpose of creating similar or competing services, or for commercial or other use without the Company's prior written consent, is prohibited unless otherwise provided by law.
In the event of an infringement of intellectual property rights, the Company may take any measures provided by law to protect its rights and legitimate interests, including requiring the infringement to cease, the removal of unlawfully used materials, compensation for losses, and the application of other legal remedies.
The Company makes reasonable efforts to ensure the continuous, secure, and proper operation of the platform but does not guarantee that its operation will be uninterrupted, timely, or completely free from technical errors or failures.
The Company is not liable for the temporary unavailability of the platform or particular functions where such unavailability results from maintenance, software updates, actions of third parties, disruptions in communication networks, equipment, hosting providers, or other circumstances beyond the Company's reasonable control.
No provision of this Agreement limits the Company's liability where such limitation is expressly prohibited by applicable law.
The Company processes users' personal data in accordance with the Privacy Policy, Personal Data Protection, this Agreement, and applicable law.
By using the platform, the user confirms that they have read the Privacy Policy and Personal Data Protection and agree to the processing of their personal data to the extent necessary to provide the services covered by this Agreement.
The Privacy Policy and the «Personal Data Protection» document form an integral part of this Agreement.
In the event of any inconsistency between this Agreement and the Privacy Policy regarding the processing of personal data, the provisions of the Privacy Policy shall apply unless otherwise provided by law.
The Company may amend this Agreement at any time, subject to the requirements of applicable law.
A new version of the Agreement takes effect from the moment it is published on the platform unless otherwise provided by law or stated in the new version itself.
If applicable law requires users to be notified of amendments, the Company shall provide such notice in the manner prescribed by law or made possible by the platform's functionality.
Continued use of the platform after a new version of the Agreement takes effect constitutes the user's acceptance of the amendments unless otherwise provided by law.
If the user does not agree with the amendments, they must stop using the platform.
This Agreement is governed by and interpreted in accordance with the laws of the Republic of Estonia unless otherwise required by mandatory provisions of applicable law.
The parties shall seek to resolve all disputes, disagreements, or claims arising in connection with this Agreement or the use of the platform through negotiations and good-faith consultations.
Before applying to a court, the user undertakes to submit a written complaint to the Company and allow the Company a reasonable period to review it and provide a response, unless otherwise provided by applicable law.
If the parties do not reach an agreement through negotiations, the dispute shall be resolved by a competent court in accordance with the laws of the Republic of Estonia, unless otherwise provided by applicable law.
If any provision of this Agreement is found to be invalid, unlawful, or unenforceable, this shall not affect the validity, legality, or enforceability of the remaining provisions, which shall remain effective to the fullest extent possible.
