This Public Offer (hereinafter referred to as the Offer) is the official proposal of WORKIUM OÜ to conclude a service agreement on the terms set out in this document.

 

The Offer is addressed to any natural person who uses the WORKIUM platform or orders services provided through it.

 

Acceptance of this Offer constitutes full and unconditional acceptance of its terms and the conclusion of an agreement between the user and WORKIUM OÜ.

 

The provisions of this Offer apply together with the User Agreement, Privacy Policy, Cookies Policy, Personal Data Protection Policy, and other documents governing the use of the WORKIUM platform.

In this Offer, WORKIUM OÜ is referred to as the «Service Provider», and the person who accepts its terms is referred to as the «Customer».

 

2. Subject matter of the Offer

 

Under this Offer, the Service Provider provides the Customer with informational, advisory, organisational, and other services related to the use of the WORKIUM platform, finding work abroad, and interacting with employers, operational partners, and other participants in the employment process.

 

The services may include, in particular:

 

• providing access to vacancies;

• the ability to apply for vacancies;

• use of the personal account area and other platform services;

• informational and advisory support;

• organisational support for particular stages of employment;

• other free or paid services available on the platform.

 

The description, scope, conditions of provision, and cost of particular services may be set out on the relevant platform pages or in other WORKIUM documents.

 

3. Acceptance of the Offer

 

This Offer is a public proposal to conclude a service agreement.

 

The agreement between the Service Provider and the Customer is considered concluded from the moment this Offer is accepted.

 

Acceptance means any action by the Customer indicating an intention to use the Service Provider's services, including:

 

• registration on the platform;

• creation of a personal account area;

• submission of an application for a vacancy;

• ordering a particular service;

• payment for a paid service;

• use of other platform services for which acceptance of this Offer is required.

 

The Customer confirms that, before acceptance, they read this Offer, understood its contents, and agreed to all of its terms.

 

4. Procedure for providing services

 

WORKIUM provides services in accordance with their description posted on the platform and the terms of this Offer.

 

Some services may be provided free of charge, while particular services may be provided for a fee. Information about the cost, ordering procedure, provision period, and other material terms of paid services is communicated to the user before the order is placed.

 

To receive particular services, the user may be required to create an account, provide additional information, or take other actions made available by the platform's functionality.

 

Services are considered properly provided from the moment they are actually delivered or access to the relevant service is opened, unless another procedure is specified in the description of the particular service.

 

WORKIUM may engage operational partners, employers, contractors, and other third parties to provide particular services while remaining responsible for fulfilling its own obligations under this Offer.

 

5. Cost of services and payment procedure

 

Unless otherwise stated on the platform, use of WORKIUM's main functions is free of charge.

 

The cost of paid services is stated on the relevant platform pages or communicated to the user before the order is placed.

 

Payment is made using the methods available on the platform at the time the order is placed.

 

The payment procedure, refunds, and other payment-related conditions are governed by the «Payment and Refunds» document, which forms an integral part of WORKIUM's document system.

 

6. Bonus programmes

 

WORKIUM may introduce bonus programmes, promotions, special offers, or other forms of user incentives.

 

The conditions of participation and the procedure for awarding, using, changing, or terminating such programmes are set out in separate rules published on the platform.

 

If particular conditions are established for receiving a bonus, the bonus is awarded only after all such conditions have been fully met.

 

7. Liability of the parties

 

WORKIUM provides services in accordance with this Offer and makes reasonable efforts to provide them properly.

 

The user undertakes to provide accurate, complete, and current information required to receive the services. If inaccurate, incomplete, or late information is provided, WORKIUM is not liable for the inability to provide or the improper provision of the relevant services.

 

If particular services are provided with the participation of employers, operational partners, or other third parties, WORKIUM is responsible only for the proper provision of its own services. Decisions regarding employment, the conclusion of an employment agreement, or other legal relations with the user are made independently by the relevant employers or other persons.

 

8. Force majeure

 

The parties are released from liability for the complete or partial failure to perform their obligations under this Offer where such failure results from force majeure circumstances that arose after the agreement was concluded, are beyond the parties' control, and could not reasonably have been foreseen or prevented by them.

 

Such circumstances may include, in particular, military action, terrorist acts, natural disasters, fires, epidemics, decisions of public authorities, disruptions in communication networks, large-scale technical failures, and other extraordinary circumstances.

 

9. Duration of the Offer and amendment procedure

 

This Offer takes effect from the moment it is published on the platform and remains in effect until it is withdrawn or replaced by a new version.

 

WORKIUM may amend or supplement this Offer due to changes in legislation, development of the platform, expansion or modification of the list of services, or for other justified reasons.

 

The current version of the Offer is always published on this page together with the date of the latest update.

 

Continued use of the platform or ordering services after a new version of the Offer takes effect constitutes the user's acceptance of its terms.

 

10. Governing law and dispute resolution

 

This Offer is governed by the laws of the Republic of Estonia unless otherwise required by applicable mandatory legal provisions.

 

If disputes arise, the parties shall seek to resolve them through negotiations.

 

If the dispute cannot be resolved through negotiations, it shall be resolved in accordance with applicable law.
